Outstanding Performance: National Chung Cheng University's Department of Law Team Wins The Championship of the National Moot Court Competition Hosted by the Lee and Li Foundation

After a critical success in 2005, the school team from the Department of Law of National Chung Cheng University (CCU) has once again won the Lee and Li Foundation's Moot Court Competition in first place. During the week-long competition, the CCU team competed with teams from 12 universities. The CCU team made their way through the preliminary round, semi-final, and all the way to the championship game as a conqueror. Not only did they win the award of Honorable Mention Debater in the individual competition, but they also won Plaintiff's Best Declaration Award, bringing the championship trophy back to CCU.

Under the guidance of the Associate Professor from CCU's Department of Law, Hueih-Wehn Liauh, graduate students from the Department including Chien-ting Chen, Yen-hung Tung, Ting-he Zhu, Shao-chieh Huang, Wei-yi Chang, and correspondent Yi-ting Ko form a delegation team. After several months of intense hardworking in pleadings writing and debate practice, the CCU team participated in the National Moot Court Competition hosted by the Lee and Li Foundation. One of the team members, Chen, indicated that the competition mainly covers issues related to Civil Law and Personal Information Protection Act. Among the cases, besides the determination of the scope of protection for personal information and privacy rights, the concepts of illegal collection and utilization of personal information, the balancing of interests and judgment of illegal profits, the responsibilities of employees, and the tort of corporations are all the core issues of the dispute. In addition, these issues are also integrated with different law fields such as the Constitution, Personal Information Protection Act, and Civil Law.

During the preliminary rounds, the law team from CCU directly encountered the reigning champions from last year, who were also the qualifying teams from National Cheng Kung University (NCKU) and Soochow University (SCU) which advanced to the top four. As for the finals, the CCU team met the ever-victorious team of the competition, the team from National Taipei University (NTPU). Recalling the most memorable part of the event, Chen pointed out that in the final round, facing five judges questioning in turn, whether it was the excavation of the details of the case, the concept of the performance of Civil Law contracts, the application of the Principle of Constitutional Proportionality, even the theoretical application of the Right to be Forgotten under Personal Information Law, or even the practical aspect of whether both parties were willing to make concessions to each other. All of these questions made student teams from both universities feel greatly pressured. However, despite being under such intense courtroom tactics, three students from the CCU team, namely Chien-ting Chen, Shao-chieh Huang, and Ting-he Zhu still managed to address the judges' tough questioning expertly, earning the judges' admiration and securing a decisive victory.

The emphasis of legal education is to cultivate student's ability to analyze, deduce and apply. Nowadays, many countries have already regarded simulated court debates as an important tool to promote legal education. In order to raise the importance of simulated court in the domestic legal education field, the Lee and Li Foundation has been holding the National Moot Court Competition since 2001, which is now in its 22nd year. The competition's goal is to provide young students with a deeper understanding of the legal system beyond just theoretical analysis by encouraging them to analyze cases, make objective decisions within the bounds of the law, and seek out the justice of the law rather than solely searching for "cookie-cutter answers" in laws or court cases.

"Although this journey has been difficult and there have been countless times when we wanted to give up, we are very glad and extremely grateful that even though the journey was full of thorns, we still gritted our teeth and managed to walk through, which finally got us to enjoy the most beautiful scenery at the end," Chen said that participating students needed to invest a significant amount of time and energy in case analysis discussion, complaint writing, and verbal debate practices. They are very grateful for the support and assistance from the College of Law, faculty members, and professors during the process. He also indicated that it has been 16 years since the school team last won the championship, this year they won again and coincides with the 30th anniversary of the establishment of the Law Department, which offers a special significance to all of us. The team expects that this legacy will continue in the future, and junior students are encouraged to participate in competitions to bring more and more honor to the school.
